keepFOCUS offers both free and paid subscription options. By selecting a paid subscription, you agree to pay all fees in accordance with the pricing and payment terms presented to you at the time of purchase.

Paid subscriptions are one-time payments that provide lifetime access to premium features. We reserve the right to change our pricing structure at any time, but such changes will not affect existing one-time purchases.

5. User Content

Our Service allows you to input and store certain content, such as task lists and productivity data. You retain all rights to your content, and you are responsible for all content that you submit.

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with providing the Service to you.

6. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable law or regulation;
  • To impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;

In no event shall keepFOCUS, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless keepFOCUS and its licensees, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, both parties agree to binding arbitration under the rules of the American Arbitration Association.
